Ben V. Hanuka was successful in having the Applicant’s franchise agreement rescinded pursuant to the Arthur Wishart Act (Franchise Disclosure), 2000, S.O. 2000, c.3 on the grounds that the contents of the documentation delivered to the Applicant did not meet the requirement of section 5 of the Act such that the Franchisor failed to provide a disclosure document for the purposes of the Act.

This case has had a notable impact on the legal definition of a “disclosure document” for the purposes of the Arthur Wishart Act.
